Andrey Shimonovich took part in the round table "Review of current judicial practice in liquidation and bankruptcy"

On Wednesday, April 24, 2019, advocate Andrey Shimonovich participated as an expert at the round table “Legal Practicum. Review of current judicial practice in liquidation and bankruptcy”, organized by the portal “System Lawyer”.

On the legal workshop were considered the legal positions of the Cassation Board of the Supreme Court of the Republic of Belarus, that are being contained in recently accepted decisions of the board and the judicial practice of the experts of the workshop.

During the discussion the following cases were analyzed:

• Solvency shall be proved.

• Exit from liquidation + compensation agreement + going to liquidation = nullity of the agreement on compensation.

• Simplified liquidation in 10 years, or What can result in a tax debt of 9 rubles.

• The separation balance sheet does not apply to management records.

• Transfer of property from the third line of creditors to the fifth.

• Bankruptcy of a company, implementing the exclusive right of the state.

• Lack of an approved assessment of the debtor’s property as a violation of the creditor’s right.
